Understand Tree Rights Between Neighbors

Trees don't recognize boundaries. They don't respect privacy fences or property lines, and occasionally this creates situations between neighbors which require clarification.

    One of the most common problems is when your neighbor's tree branches hang over into your yard. Legally you can trim the branches, but only up to the adjoining property lines. If trimming causes the tree to die, you are liable.

  • Even if all a tree's branches hang into your yard, but the trunk is on your neighbor's property, the entire tree belongs to him. You can still maintain the branches but can't dig up the tree or do anything else to destroy it.
  • If a storm knocks down tree limbs belonging to the property next door and they damage your car, home or any other personal items, several factors come into play in determining if your neighbor is liable for damages. If the tree has been maintained then it will probably be classified as an "Act of God" and no damages will be awarded.
